ignificance of the Prior Examination System for Item Classification

This is a civil complaint reply system that allows exporters and importers to have difficulty in classifying items on their own prior to filing an import/export declaration, and if they apply to the head of the Customs Valuation and Classification Office of the Korea Customs Service as stipulated by laws and regulations, determine the legally effective item number and reply. (Article 86 of the Customs Act and Article 106 of the Enforcement Decree of the Customs Act)

Item classification pre-examination application procedure

applicant

A person who intends to import/export goods, a manufacturer of goods to be exported, and a customs broker, customs corporation, or customs handling corporation under the Customs Service Act.

How to apply

  • Apply online, by mail or in person, attaching an application for pre-screening of item classification (forms G and Eulji in Attachment No. 1 of the Notice on the Operation of Pre-Examination of Item Classification), samples and supporting documents

Items to be returned

  • In case the application requirements are not met (if the formal requirements are not met or the details of the application cannot be confirmed, etc.)
  • In case the applicant has already reported import/export of the same goods as the goods for which the applicant has applied for prior examination or re-examination
  • When it is difficult to ensure consistency of ingredients and composition because the manufacturing process is not standardized as an agricultural product mixture
  • Items whose condition may change depending on the means of transport and storage method, such as refrigerated/frozen items
  • Goods that are difficult to analyze at the central customs analysis office
  • If the correction data is not submitted within the specified period
  • If there is a request for return from the applicant
  • Articles under investigation, objection, or administrative litigation
  • If the analysis fee is not paid within the payment deadline
  • When a person who has not paid the analysis fee applies for pre-examination

Notification of decision on prior examination of item classification

The notification of decision on the pre-examination of item classification is printed out directly by the applicant using the Internet.

For items requiring analysis, an analysis fee of KRW 30,000 is paid to the bank receiving the national treasury.

A separate notice is sent after receiving the item classification pre-examination

If the item number in the notification of decision is different from the importing country, please report it to the HS International Dispute Reporting Center of Wooriwon.

Effect of pre-examination of item classification

If the goods declared for export and import are the same as those returned, the head of the customs office applies the classification according to the content of the notice.

How to print the analysis fee bill

For items requiring analysis, 30,000 won per application item is paid to the National Treasury Receiving Bank before analysis begins.

As the analysis fee is non-tax income, it is not subject to the tax invoice. (VAT not included)

Significance of the re-examination system

This is a system in which a person who has been notified of the pre-examination of item classification requests that the head of the Customs Valuation and Classification Service re-examine only once within 30 days from the date of notification. Operational Notice Article 3)
