자녀가 7세 미만이면 무조건 엄마가 돌보아야 한다네요. 이 기사에는 안나왔지만 어디에선가 읽은 기억으로는 아내가 정신병력이 있거나, 전염이 가능한 질병등이 있는 경우에는 예외라고 읽은적 있습니다.

The Court shall take into account all relevant considerations, especially the choice of the child over seven years of age, unless the parent chosen is unfit. 이 조항의 해석을 아래와 같이 해 놓았습니다. The law categorically provides that no child under seven years of age shall be separated from the mother, unless the court finds compelling reasons to order otherwise (Article 213, Family Code). In other words, the law presumes that the mother is the best custodian,which finds its reason in the basic need of a child for his mother’s loving care. Moreover, insofar as illegitimate children are concerned, they are under the parental authority of their mother (Article 176, Family Code).

참 웃기는게 법이라는것은 사회상을 반영해야 하는것인데, 엄마가 돌보기는 커녕 아이들을 할머니에게 맡기고 도망가버리는 경우가 필리핀에서는 다반사입니다. 현실이 이러할진데, 저런 법이 무슨 소용이 있을까 싶네요.

이 문제 때문에 코필 가정 가운데 자녀가 어린 경우 아내와 자녀만 필리핀에 보내지 말라는 조언들이 많이 있지요. 매년 이런 피해가 실제로 발생되었으니까요. 뭐 지금은 코로나로 인해서 필리핀 들어가는 것도 까다롭지만요.
