영주권, 은퇴비자, 워킹비자, 투자비자, 47(a)(2) 비자 (특별경제구역비자, 외교관비자 등) 

소지자에 대한 SSP 및 Student Visa 의 면제규정

 

1. 상기 사항에 대해 여러분의 질문이 있어, 다시 한번 안내드립니다.

2. 이민국 훈령(SBM2015-007,2015년5월19일제정)의 내용입니다.

    The following foreign nationals shall be
                         exempt from securing Student Visa or SSP:
       Tertiary enrolment in Philippine schools of the spouses and
        unmarried dependent children below twenty-one (21) years old of:
          a. A permanent foreign resident;
          b. Foreign nationals with valid working visas under Sections 9(d),
              9(g) and 47(a)(2) of Commonwealth Act No. 613, as amended;
          c. Personnel of foreign diplomatic and consular missions residing in
              the Philippines;
          d. Personnel of duly accredited international organizations residing
              in the Philippines;
          e. Holders of Special Investor’s Resident Visa (SIRV) and Special
              Retiree’s Resident Visa (SRRV); and
          f. Foreign students coming in the Philippines with 47(a)(2) visas
             issued pursuant to existing laws, e.g. Pres. Decree No. 2021.
      This privilege is also extended to the principals who may wish to take
      advantage of the educational facilities in the country.

       보시면 tertiary enrolment 즉 대학교 과정에 한하여, SSP나 Student Visa가

       면제됩니다.

3. 그러나 학교 몇군데에 확인 한 것으로는 초등학교(Primary) 와 고등학교(Secondary)

    과정도 SSP를 면제하고 있습니다. 하지만 법령이 대학과정에 한한 것으로 나와 있고,

    법령이 제정된 지 얼마되지 않아, 지금의 관행이 추후에 바뀔 가능성이 있는 것으로 보입니다.

4. 그리고 이민국에서도 장기비자 소지자의 초등,고등학교과정 Student Visa나 SSP 미소지에

    대해서는 현재까지 불법으로 언급하지 않고, 학원과정에서는 SSP가 있어야 한다는 입장을

    보이고 있습니다.
